Sales Policy
1. General Terms and Conditions:
These general terms and conditions expressly regulate the relationships arising between Bodegas Castillo de Monjardín S.A., hereinafter “CASTILLODEMONJARDIN,” and those third parties, hereinafter “Users,” who purchase the products offered through the website: www.monjardin.es, hereinafter the “Portal.”
2. Purchase Process:
To purchase the products indicated on the Portal, the following steps must be followed:
– Create a User account by registering the personal data listed in the electronic form provided for this purpose. Creating a user account will be an essential requirement for purchasing products, and as a preliminary step, it will be necessary to accept the privacy policy indicated in the registration form.
– An email will be sent to the email address provided by the user confirming the registration data and the access password (the User will be responsible for any operation carried out with it).
– Access the Portal, register the User, browse, and select the desired product by adding it to the “shopping cart” by clicking on the word “buy” that appears next to the product.
– On the “shopping cart” screen, confirm the User’s data, the purchased product, applicable taxes, shipping costs (included in the price), and the payment method.
– Complete the purchase by clicking on the word “buy” or cancel the order.
– An email will be sent to the email address provided by the user confirming receipt of the order acceptance.
– Payment for the product.
– Shipment and delivery of the product.
3. Products Offered, Prices, and Shipping Costs:
The products offered on the Portal, along with their essential characteristics, prices, taxes, and costs, will appear on the screen before the purchase is made.
Any offers that may exist for certain products at any given time will be clearly indicated in a specific section of the Portal.
Products will be available for sale while stocks last, and the purchase process cannot be completed if the products are entirely out of stock.
If, for any reason, it is not possible to supply the contracted products, the User will be informed and may accept the delivery of a product with similar characteristics of the same or higher quality, or, if applicable, request a refund of the amounts paid.
4. Payment Method:
Payment can be made via:
– Credit Card: through La Caixa’s payment gateway using a secure server that guarantees the integrity and confidentiality of the data provided.
– Bank Transfer: You will receive an acceptance email of the order in which the bank account number where you must make the payment for the purchased products will be communicated. You must send the payment receipt to patricia@monjardin.es
5. Delivery of Products:
Once the payment for the products is confirmed, CASTILLODEMONJARDIN undertakes to deliver the purchased goods to the user’s address indicated for this purpose within a period not exceeding 30 days.
Under no circumstances will products be delivered to P.O. boxes or call centers.
You will be informed by email when the order is dispatched, and you will be able to track its status with CASTILLODEMONJARDIN.
6. Withdrawal:
The User will have a period of seven (7) business days, counting from the receipt of the products, provided that the nature of the product allows it and according to the official calendar of their place of residence, to return the product. In this case, the return costs will be borne by the User.
To return the product, the User must notify CASTILLODEMONJARDIN, and the product must be in perfect condition. After verifying the product’s condition, CASTILLODEMONJARDIN will refund the received amounts as soon as possible and never within more than thirty days. The paid shipping costs will not be refunded.
Returns of the products must be sent to the address of CASTILLODEMONJARDIN, Viña Rellanada s/n. Villamayor de Monjardín (Navarra), Spain.
7. Jurisdiction and Competent Courts:
This contract will be interpreted and governed by Spanish law. CASTILLODEMONJARDIN and the User agree to try to resolve amicably any disagreement that may arise in the development of this Contract before resorting to the jurisdiction contemplated.
The User acknowledges and accepts that this Contract and the claims and liabilities arising from it are subject to Spanish law. Therefore, they agree that any dispute, discrepancy, issue, or claim resulting from the execution or interpretation of this Contract or related to it, directly or indirectly, will be definitively resolved in the Courts and Tribunals of Navarra, expressly waiving any other jurisdiction that may correspond to them by law.
